WHAT'S THE POINT OF THIS POLICY?

Axiocap attaches great importance to the protection and confidentiality of your personal data, which we take seriously and trust.

This data privacy policy precisely reflects our commitment to ensuring that Axiocap complies with the applicable data protection rules and, more specifically, those of the General Data Protection Regulation ("GDPR").

In particular, the privacy policy aims to inform you about how and why we process your data in connection with the services we provide.

WHO IS THIS POLICY AIMED AT?

The policy applies to you, regardless of where you live, as long as you are a customer or visitor to www.axiocap.com or a customer or user of our www.app.axiocap.com solution.

This policy applies only to the processing carried out by us and not to the processing that may be carried out by our customers using the functionalities of our service. If you would like information about the data processed by our customers using these features, please contact them directly.

AGE OF THE PERSON PROVIDING PERSONAL DATA 

As the collection of personal data can only concern persons aged at least 18 (eighteen), and is necessary for the performance and administration of the services ordered or requested via the site, persons under 18 (eighteen) can only give their consent to the collection of their personal data (and consequently access the services deployed via the site) on condition that they are authorized by the holder of parental responsibility for them so that, by requesting the services accessible via the site and/or by communicating personal data to Axiocap, you represent and warrant to Axiocap that you are either (i) at least 18 (eighteen) years of age, or (ii) authorized by the holder of parental responsibility for you. This stipulation is without prejudice to your undertaking to Axiocap that you represent and warrant to Axiocap that you have the legal capacity to use the Axiocap services delivered via the Site and, where applicable, to pay for such services.

 

WHY DO WE PROCESS YOUR DATA?

The processing of your data is necessary for the performance of the contractual relationship that you wish to enter into with Axiocap by ordering and/or using services and/or benefits, the said personal data being necessary for the performance of the benefits and/or Services ordered (ii) the processing is also necessary to protect the legitimate interests of Axiocap by enabling it to keep proof of transactions and/or if necessary proceed with collection (iii) the processing is based on your consent if you wish to order, use benefits and/or services via the site (iv) the processing being administered in accordance with the provisions of Law n°78-17 of January 6, 1978 and EU Regulation 2016/679 of April 27, 2016 (RGPD) and other legal provisions in force. 

The recipients of personal data are the Axiocap staff in charge of carrying out and/or administering the services ordered and/or used, the carrying out and/or delivery by Axiocap of the services ordered and/or used and, where applicable, Axiocap's subcontracted service providers participating in the carrying out of these tasks and having to intervene in this respect on the processing (only when necessary), it being specified that in such a case this is carried out in compliance with the Regulations in force applicable to subcontractors.

As part of the services we offer, we may need to process your personal data in order to :

browse our website, benefit from our services and so that we can respond to your requests (examples: requests for information, complaints, etc.) on the basis of our general terms of use and our legitimate interest in providing you with the best possible service.

record the conversations we have with you during our commercial prospecting calls, on the basis of your prior consent.

follow us and comment on our publications on social networks on the basis of our legitimate interest in benefiting from a dedicated page on social networks.

receive our newsletter which informs you about all the news concerning our services on the basis of your consent.

operate the videos on our site on the basis of our legitimate interest in offering you content in video format.

make an appointment with our teams based on our legitimate interest in offering you a way to easily make an appointment with us.

geolocate your position in order to provide you with a more fluid and accessible service, based on your prior consent.

Your data is collected directly from you when you use our website and we undertake to process your data only for the purposes described above.

On the other hand, when you voluntarily publish content on the pages we publish on social networks, you acknowledge that you are entirely responsible for any personal information you may transmit, whatever the nature and origin of the information provided.

At most, we only use cookies that are anonymized and therefore exempt from consent, in accordance with the provisions of the CNIL.

WHAT DATA DO WE PROCESS AND FOR HOW LONG?

We have summarized the categories of personal data we collect and their respective retention periods.

If you would like further details on the retention periods applicable to your data, please contact us at dpo@axiocap.com.

Professional identification data (e.g. surname, first name, position, company, etc.) and contact details (e.g. e-mail address and business telephone number, etc.) retained for the duration of the service, plus the statutory limitation periods, which are generally 5 years.

When there is confusion between the name of your structure and your personal name (e.g.: auto-entrepreneur, TPE, etc.), economic and financial data (e.g.: bank account number, verification code, etc.) kept for the time necessary for the transaction and the management of invoicing and payments, plus the statutory limitation periods, which are generally 5 to 10 years.

Email address for our commercial email prospecting campaigns, kept for a maximum of 3 years from the last contact we had with you.

Telephone number for our commercial telephone prospecting campaigns, kept for a maximum of 3 years from the last contact we had with you.

Email to receive our newsletter kept until the end of your newsletter subscription.

Geolocation data stored for a maximum of 2 months.

Statistical data relating to the viewing of our videos, which are anonymized and stored indefinitely.

Connection data (e.g. logs, IP address, etc.) stored for 1 year.

Cookies which are generally stored for a maximum of 13 months. For more details on how we use your cookies, you can consult our cookie policy, which can be accessed at any time on our website.

And more generally, any information you provide by filling in forms relating to the creation of your account or relating to your orders or relating to your identification, or by communicating with Axiocap (by any means of communication, or by responding to questionnaires or satisfaction surveys), which concerns in particular your name, gender, date and place of birth, as well as your contact details such as your postal address, e-mail address, telephone numbers, as well as information relating to the contractual and commercial relationship between you and Axiocap (in particular details of services ordered), and banking information (bank details, card numbers) and transactional information, as well as data collected thanks to cookies and similar technologies used on the site (in particular IP addresses) and in electronic messages enabling us to recognize you, remember your preferences and, where appropriate, present you with content likely to be of interest to you.

These personal data may only be communicated to Axiocap by you and you agree not to communicate personal data of another person and/or personal data that does not concern you.

 

Once the above-mentioned retention periods have expired, the deletion of your personal data is irreversible and we will no longer be able to communicate it to you. At most, we can only keep anonymous data for statistical purposes.

Please also note that in the event of litigation, we are obliged to retain all data concerning you for the duration of the case, even after the expiry of the retention periods described above.

WHAT RIGHTS DO YOU HAVE TO CONTROL THE USE OF YOUR DATA?

The applicable data protection regulations grant you specific rights which you can exercise, at any time and free of charge, to control the use we make of your data.

● The right toaccess and copy your personal data, provided that this request does not conflict with business secrecy, confidentiality or the secrecy of correspondence;

● Right to rectify personal data that is incorrect, outdated or incomplete;

● The right to object to the processing of your personal data for commercial prospecting purposes;

● Right to request the deletion ("right to be forgotten") of your personal data that is not essential to the proper functioning of our services;

● Right to limitation of your personal data, which allows you to photograph the use of your data in the event of a dispute over the legitimacy of a processing operation ;

● The right to data portability, which enables you to retrieve part of your personal data so that it can be easily stored or transmitted from one information system to another; 

● The right to give instructions on what to do with your data in the event of your death, either through you or through a trusted third party or beneficiary;

For a request to be taken into account, it must be sent directly by you to dpo@axiocap.com. Any request not made in this way cannot be processed.

Requests cannot come from anyone other than you. We may therefore ask you to provide proof of identity if there is any doubt about the identity of the person making the request.

We will respond to your request as quickly as possible, within one month of receipt, unless the request is complex or repeated. In this case, the response time may be up to three months.

Please note that we can always refuse to respond to any excessive or unfounded request, particularly if it is repetitive.

Insofar as necessary, you are reminded that the exercise of the right to erase personal data and/or the exercise of the right to object to the processing of personal data and/or the exercise of the right to restrict the processing of personal data and/or the right to withdraw consent at any time to the processing of personal data (in accordance with the aforementioned stipulations) leads to the delivery of the services ordered and/or used not being possible and, more generally, to the services ordered and/or used not being possible, to make it impossible to provide the services ordered and/or used, so that, in such cases (i) as from the exercise of the said rights, you will no longer be able to access the services provided by Axiocap via the site (ii) if these rights are exercised at the time of ordering services, the said order cannot be carried out (iii) and, if you are the holder of a contract relating to the Axiocap application software solution, your personal data recipient account will be deleted.

WHO CAN ACCESS YOUR DATA?

WE NEVER TRANSFER OR SELL YOUR DATA TO THIRD PARTIES OR BUSINESS PARTNERS. ALL YOUR PERSONAL DATA IS USED EXCLUSIVELY BY OUR STAFF OR BY OUR IT SERVICE PROVIDERS.

More specifically, we only pass on your data to persons duly authorized to use it in order to provide you with our service, such as our IT department or our customer relations department.

Your personal data is also transferred to our IT service providers for the sole purpose of ensuring the technical operation of our service (e.g. data hosting provider).

We check all our IT service providers before recruiting them, to ensure that they comply scrupulously with the applicable rules on personal data protection.

HOW DO WE PROTECT YOUR DATA?

We implement all the technical and organizational means required to guarantee the security of your data on a day-to-day basis and, in particular, to combat any risk of unauthorized destruction, loss, alteration or disclosure of your data (e.g. training, access control, passwords, antivirus, "https", etc.).

CAN YOUR DATA BE TRANSFERRED OUTSIDE THE EUROPEAN UNION?

Unless strictly necessary and on an exceptional basis, we never transfer your data outside the European Union, and your data is always hosted on European soil. Furthermore, we do our utmost to recruit only service providers who host your data within the European Union.

Should our service providers nevertheless transfer your personal data outside the European Union, we scrupulously ensure that they implement appropriate guarantees to ensure the confidentiality and protection of your data.
