The legal framework of the electronic signature
WHAT THE LAW SAYS
Decree no. 2017-1416 of September 28, 2017 on electronic signatures brought French law into line with the European eIDAS regulation of July 23, 2014.
‍
In this sense, it is taken in application ofArticle 1367 of the Civil Code, which makes electronic signatures enforceable.
‍
This article establishes a presumption of reliability for qualified electronic signatures. Nevertheless, it recognizes the probative nature of electronic signatures, and has done so since Law no. 2000-230 of March 13, 2000 (former article 1316-4 of the Civil Code).
‍
Subsequently, the decree on the dematerialization of company registers, minutes and decisions of October 31, 2019 specifically set out the case of minutes.
