THE LEGAL FRAMEWORK OF THE PERSONNEL REGISTER
WHAT THE LAW SAYS
It is compulsory for companies to keep a single personnel register as soon as an employee is hired (in accordance with article L. 1221-13 of the French Labor Code).
It must be kept for five years from the date on which the employee or trainee leaves the company (as per article R. 1221-26 of the Labor Code).
Failure to draw up a RUP constitutes a fourth-class contravention punishable by a fine of up to €750 for individuals and €3,750 for corporate entities (article R. 1227-7 of the Labor Code). To dematerialize your single personnel register, make sure you have entered all the information relating to each of your employees, whether active (those still working for your company) or inactive (those who have been your employees for a certain length of time but are no longer). The dematerialized UPR is indelible. However, employee information can be updated or corrected in case of error.
The single personnel register can be dematerialized after consultation of the CSE in companies that have one. The information recorded in the single personnel register must be kept for 5 years after the departure of the employee or trainee from the establishment.
